Terms of Service

These Terms govern your access to and use of RareAlert's website, dashboard, saved searches, marketplace data, alerts, emails, and related collector tools.

1. Acceptance of these Terms

By accessing or using RareAlert, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.

2. Eligibility and accounts

You must be legally capable of entering into these Terms. If you are under the age of majority where you live, you may use RareAlert only with permission and supervision from a parent or legal guardian.

You are responsible for the accuracy of information associated with your account and for protecting access to your email, authentication provider, and devices. Notify us promptly if you suspect unauthorized use.

3. What RareAlert provides

RareAlert helps users organize marketplace searches, discover public listings, track price-related information, save or hide results, and receive optional alerts. RareAlert is an independent discovery and information service. It is not eBay, a marketplace, a seller, an auctioneer, an escrow service, or a party to transactions between users and third-party marketplaces or sellers.

4. Marketplace data and availability

Listing information is supplied by third parties and may be delayed, incomplete, duplicated, inaccurate, changed, or removed without notice. Prices, shipping, taxes, availability, seller information, listing end times, and item descriptions must be verified on the marketplace before you purchase or bid.

RareAlert does not guarantee that every matching listing will be found, that an alert will arrive before a listing ends, or that any listing is authentic, fairly priced, safe, or suitable for purchase.

5. Alerts and email communications

You may choose to receive service and alert emails, including notices about matching listings, price changes, saved auctions, account activity, and security. Delivery timing is not guaranteed and may be affected by scan schedules, provider outages, marketplace changes, spam filtering, or other factors outside RareAlert's control.

You may disable optional alert emails through available account settings. We may still send essential account, security, legal, or transactional messages where permitted by law.

6. Affiliate relationship

RareAlert participates in the eBay Partner Network. As an eBay Partner Network Affiliate, RareAlert may earn from qualifying purchases made through eligible eBay links, at no additional cost to you. Affiliate compensation does not guarantee or influence the accuracy, condition, authenticity, or value of a listing.

7. User responsibilities

You agree not to:

  • use RareAlert for unlawful, fraudulent, deceptive, or abusive activity;
  • attempt to bypass authentication, access controls, rate limits, or security measures;
  • scrape, crawl, copy, or extract the service except through features we expressly provide;
  • interfere with RareAlert, its infrastructure, users, providers, or marketplace APIs;
  • use automated methods to overload the radar, generate excessive requests, or evade limits;
  • upload or transmit malicious code or content that infringes another person's rights; or
  • misrepresent your relationship with RareAlert, eBay, or any marketplace or seller.

8. Purchases and third-party services

Purchases, bids, payments, returns, refunds, shipping, disputes, taxes, warranties, and seller communications occur through third-party services and are governed by their rules. RareAlert is not responsible for a transaction, seller, buyer, payment processor, carrier, or marketplace. You are responsible for performing your own review before acting.

9. Intellectual property

RareAlert's software, branding, visual design, text, organization, and original features are owned by RareAlert or its licensors and are protected by applicable intellectual-property laws. Third-party names, trademarks, listing images, and marketplace data remain the property of their respective owners.

10. Beta features and service changes

Some features may be offered as beta, preview, experimental, or free access. We may add, modify, suspend, limit, or discontinue any feature at any time. We may introduce usage limits, paid plans, or eligibility requirements with reasonable notice where appropriate.

11. Account deletion, suspension, and termination

You may stop using RareAlert at any time. You may also permanently delete your account from Account Settings. Account deletion is irreversible and removes the authentication account and associated user-specific data, including saved searches, alerts, preferences, favorites, hidden listings, listing notes, and account settings.

Certain shared marketplace records, de-identified or aggregated information, anonymized outbound-click records, security records, and information retained to comply with law or prevent abuse may remain after account deletion.

We may suspend or terminate access when reasonably necessary to protect users or the service, enforce these Terms, comply with law, address abuse or security risks, or respond to third-party platform requirements. Provisions that by their nature should survive termination will remain in effect.

12. Disclaimers

RAREALERT IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RESULTS.

RareAlert does not provide financial, investment, appraisal, legal, tax, authentication, grading, or professional purchasing advice. Collectibles can lose value, and past prices do not predict future value.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RAREALERT AND ITS OPERATORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, DATA, OPPORTUNITIES, OR GOODWILL; OR LOSSES ARISING FROM THIRD-PARTY LISTINGS, TRANSACTIONS, ALERT TIMING, SERVICE INTERRUPTION, OR UNAUTHORIZED ACCESS.

Where liability cannot be excluded, it will be limited to the greater of the amount you paid RareAlert during the three months before the event giving rise to the claim or $100. Some jurisdictions do not permit certain limitations, so portions of this section may not apply to you.

14. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless RareAlert and its operators from claims, losses, liabilities, and expenses arising from your misuse of the service, violation of these Terms, unlawful conduct, or infringement of another person's rights.

15. Changes to these Terms

We may update these Terms as RareAlert changes. The revised Terms will be posted here with an updated date. Your continued use after the effective date means you accept the revised Terms, except where additional consent is required by law.
